These Terms & Conditions ("Terms") govern your use of Gamma Games (the "App"), a mobile application developed and operated by Swiftware.IO ("we", "us", or "our"), a company legally registered in London, United Kingdom.

By downloading, installing, or using Gamma Games, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old (or 16 in the EEA/UK) to use Gamma Games. By using the App, you represent that you meet this age requirement. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

To access certain features, you must create an account using email, Google, or Apple sign-in. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Providing accurate and up-to-date information.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the App

Gamma Games provides a curated mobile game catalog, daily streaks and coin rewards, an AI-powered chat assistant (Gamma AI), favourites and discovery features, and cross-platform play on iOS and Android.

You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not:

  • Attempt to gain unauthorised access to our systems or other users' accounts.
  • Use automated scripts, bots, or other tools to interact with the App.
  • Exploit, manipulate, or abuse the streaks, coins, or rewards system.
  • Interfere with or disrupt the App's functionality or infrastructure.
  • Use the App to transmit harmful, offensive, or illegal content.
  • Reverse-engineer, decompile, or disassemble any part of the App.

4. Streaks and Coins

Gamma Games features a daily streak system and virtual coins earned through regular use. These are virtual items with no real-world monetary value and cannot be exchanged, transferred, or redeemed for cash. We reserve the right to modify, adjust, or reset streak and coin balances at any time for operational reasons, including but not limited to system maintenance or abuse prevention.

5. Gamma AI

Gamma AI is an in-app assistant powered by third-party AI technology (DeepSeek). Gamma AI provides game recommendations, tips, and general assistance. Please note:

  • Gamma AI responses are generated algorithmically and may not always be accurate or appropriate.
  • We do not guarantee the accuracy, completeness, or suitability of AI-generated content.
  • Do not share sensitive personal information in AI conversations.
  • We may log conversation data for service improvement, subject to our Privacy Policy.

6. Subscriptions and Payments

Gamma Games offers a free tier and an optional premium subscription (Gamma Premium), managed through RevenueCat and processed by the Apple App Store or Google Play Store.

  • Billing: subscriptions are billed on a recurring basis (monthly or annually) as selected at the time of purchase.
  • Auto-renewal: subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Cancellation: you may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period.
  • Refunds: refund requests are handled by Apple or Google in accordance with their respective refund policies.
  • Price changes: we may adjust subscription pricing. You will be notified in advance, and continued use after a price change constitutes acceptance.

7. Advertisements

Free-tier users may see advertisements served by Google AdMob. These ads are not controlled by us and are subject to Google's advertising policies. Gamma Premium subscribers enjoy a reduced-ad or ad-free experience as described in the subscription offering.

8. Intellectual Property

All content, features, and functionality of Gamma Games — including but not limited to text, graphics, logos, icons, images, software code, and the overall design — are the exclusive property of Swiftware.IO or its licensors and are protected by UK and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

9. User Content

If you submit content through the App (such as messages to Gamma AI), you grant us a non-exclusive, royalty-free, worldwide licence to use, process, and analyse that content for the purpose of providing and improving the App. You retain ownership of your content.

10. Third-Party Services

The App integrates with third-party services including Supabase, DeepSeek, RevenueCat, Google AdMob, Apple, and Google. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

11. Disclaimer of Warranties

Gamma Games is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • Merchantability, fitness for a particular purpose, and non-infringement.
  • Uninterrupted, error-free, or secure operation of the App.
  • Accuracy or reliability of any content, including AI-generated responses.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Swiftware.IO and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the App.

Our total aggregate liability for any claims arising from these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or £50, whichever is greater.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold harmless Swiftware.IO and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

14. Termination

We may suspend or terminate your access to Gamma Games at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in the European Union or United Kingdom, you retain any mandatory consumer protection rights granted by the laws of your country of residence.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Swiftware.IO regarding your use of Gamma Games and supersede all prior agreements and understandings.
